Terms and Conditions of Service
The following terms and conditions govern all work undertaken by Cultivate Picnics. By engaging our services, you agree to these terms unless otherwise stipulated in a written agreement signed by both parties.1. Bookings
Full payment is required before any setup or service is rendered.2. Cancellations
In the event of adverse weather conditions, clients may reschedule an outdoor picnic within a period of three (3) months from the original booking date.3. Payment Terms
A non-refundable deposit of 50% is required to secure your booking. The remaining balance is due one week prior to the event. For bookings made within seven (7) days of the event date, full payment is required at the time of booking.4. Equipment
All equipment provided by Cultivate Picnics remains the property of the company and must be returned in the condition in which it was provided. Clients will be charged for any loss or damage to the equipment.5. Rescheduling
Should you need to reschedule your event, a minimum of seventy-two (72) hours' notice is required. Rescheduling is subject to approval by Cultivate Picnics and is dependent on availability. A rescheduling fee of 20% of the event cost will apply for any date changes. Rescheduling is subject to availability, and a new date must be agreed upon within 24 hours of the request. All rescheduled events must occur within three (3) months of the original event date. Rescheduling does not alter the terms of the contract beyond the date of service.6. Travel Fee
A travel fee will be applied for events located beyond a fifteen (15) kilometer radius from Seapoint, Cape Town. This fee is subject to discussion and mutual agreement based on the distance and accessibility of the event location.7. Menu
All menu items are subject to change based on seasonal produce availability. Cultivate Picnics reserves the right to substitute any menu item with a comparable alternative.8. Picnic Notice Period
We recommend booking as early as possible to avoid disappointment. Availability is limited, and bookings are accepted on a first-come, first-served basis.9. Client Responsibilities
Clients are responsible for providing accurate and complete information regarding the event and ensuring compliance with any local laws and regulations, including obtaining necessary permits or permissions for the event.10. Liability and Indemnity
Cultivate Picnics shall not be liable for any direct, indirect, incidental, or consequential damages arising from the services provided, except in cases of gross negligence or willful misconduct. Clients agree to indemnify and hold Cultivate Picnics harmless from any claims, damages, or expenses arising out of their use of the services. Cultivate Picnics is not liable for the possession or use of alcohol or other substances at the event. Clients assume full responsibility for any consequences arising from their provision.11. Picnic Protocol Contract
- Cultivate Picnics reserves the right to refuse service at its discretion.
- Punctuality is essential. Our picnics are carefully timed for optimal execution. If you are late, we cannot extend your allotted time unless pre-arranged. A 15-minute grace period is provided. Please do not arrive early, as we use all available time to ensure your setup is perfect.
- Respect for the beach and fellow beachgoers is expected at all times.
- Clients are responsible for all equipment during the picnic. Any damage or loss will be charged accordingly.
- Candles provided are for display purposes only and should not be lit unless prior arrangements have been made.
- Equipment should not be stood on, sat on, or moved without permission.
- Floral arrangements are not intended as take-home items. If you wish to keep the flowers, they can be upgraded for an additional fee.
- While we strive to fulfill all aesthetic desires, our services are prepackaged. Final decisions regarding the look, feel, and artistic quality of the service rest with Cultivate Picnics. Customized designs are available through our customized package.
- In the event of strong winds, high tides, or other environmental hazards, Cultivate Picnics may recommend a change in location to ensure the safety of staff, clients, and the overall picnic experience.
- If umbrellas are affected by unexpected wind, please close them immediately.
- Picnic tables should not be left unattended for extended periods.
- Events held outside our standard service radius of fifteen (15) kilometers from Seapoint may incur additional travel fees, subject to prior approval by Cultivate Picnics.12. Social Media and Content Sharing
By engaging our services, you grant Cultivate Picnics the right to capture and share images from your event on our social media platforms and other promotional materials. We may use these images for marketing purposes, showcasing the experiences we create. If you do not wish for your images to be shared, please inform us in writing prior to the event.13. Force Majeure
Cultivate Picnics shall not be liable for any failure to perform its obligations under these terms due to events beyond its reasonable control, including but not limited to acts of God, war, civil unrest, strikes, or other unforeseen events.14. Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa, and any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.15. Confidentiality and Privacy
Cultivate Picnics is committed to protecting the privacy of its clients. Any personal information collected will be used solely for the purpose of providing the services and will not be shared with third parties without consent, except as required by law.16. Refund Policy
All sales are final. Cultivate Picnics does not offer refunds under any circumstances.
